A DAD was caught over the drink-drive limit while his daughter was in the back seat of his car, a court heard.

Jason Martin Hushie, 40, admitted being over the legal limit while picking up his daughter from school in Weymouth.

Prosecutor Julian Lawrence told Weymouth magistrates that police officers were called to Cross Road in Weymouth just before 3pm on March 11.

Hushie was discovered waiting in his car near the school gates to pick up his daughter.

His younger daughter was in the back seat.

Mr Lawrence told magistrates: “Officers saw a Ford Focus and in the back of the car was a two-year-old girl who was the defendant’s daughter. They asked why he was waiting and he said he was waiting to pick his daughter up from school.”

Hushie gave a positive result in a roadside breath test, Mr Lawrence said.

He added that Hushie’s alcohol levels were tested again in custody and 130mg of alcohol was found in 100ml of urine.

The legal limit is 107mg.

“Mr Hushie said that had the police not stopped him he would have taken the kids back from school and back home,” Mr Lawrence added.

Hushie, formerly of Clifton Place, Weymouth, pleaded guilty to being in charge of a vehicle while his alcohol level was above the limit and to a further offence of shoplifting alcohol from Harbour Stores in Weymouth on April 29.

Mr Lawrence said: “In interview he said he had been drinking that day and was eight out of 10 on the drunkenness scale.”

Lee Christmas said in mitigation that Hushie, who now lives in Hamilton Close, Brighton, was a ‘fraction’ over the drink drive limit but an aggravating feature was having a child in the car.

He added: “Mr Hushie has stayed out of trouble for the last seven years and got drunk and walked into the shop to take the alcohol. He has no recollection of it. Mr Hushie is a qualified motor mechanic and has been working abroad in Kuwait.”

Magistrates fined Hushie £185 and added 10 penalty points to his licence for the drink driving offence.

He was given a 12-month conditional discharge for the shoplifting charge.
